By using our Services, you consent to the practices described in this policy.

We collect personal information that you voluntarily provide when you:

  • Register an Account: Name, email address, phone number, usernames, and password.

  • Subscription Details: Billing information necessary to process payments.

  • Accountability Partner Information: Contact details (email and phone number) of individuals you designate to receive notifications.

  • Phone Numbers: We collect phone numbers to send SMS notifications about account activity and detected content alerts. Message and data rates may apply.

2.2 Usage Data

When you interact with our Services, we may automatically collect:

  • Device Information: IP address, browser type, operating system, device identifiers.

  • Website Activity: Pages visited, links clicked, time spent, and other analytics data.

  • Extension Activity: Our browser extensions may capture additional contextual data, such as website URLs, page titles, and select visible text or images, for the purpose of detecting and analyzing inappropriate content.

2.3 App-Specific Data

  • Screenshots: The App periodically captures screenshots of the user's device screen.

  • Content Analysis Data: Information generated from analyzing screenshots and extension data for explicit or inappropriate content.

  • Facial Recognition Data: If enabled by the account holder, users may upload facial images for training. These images and related metadata are stored securely and used solely to identify which family member was active on the device during content detection events.

  • Notification Logs: Records of alerts and reports sent to your designated accountability partners.

3. How We Use Your Information

We use the information collected for the following purposes:

3.1 Providing and Improving Services

  • Content Monitoring: To analyze screenshots for inappropriate content using our AI algorithms.

  • Notifications: To send reports and alerts to your accountability partners via email and SMS.

  • Account Management: To manage your user account, process payments, and provide customer support.

  • Website Functionality: To maintain and improve our website's performance and user experience.

3.2 Communications

  • Transactional Messages: Important updates about your account and services.

  • Account Notifications: Email and/or SMS notifications regarding monitored content as described in the service. 

  • Promotional Communications: Information about new features, offers, or products we think may interest you (you may opt-out at any time).

  • Service Announcements: Notifications about changes to our Services, policies, or security updates.

  • SMS notifications are sent based on account activity or detected content events, device connection events and device disconnection events on user's account. Message frequency varies.

3.3 Legal Compliance and Security

  • Legal Obligations: To comply with legal requirements, court orders, or in response to lawful requests by public authorities.

  • Protecting Rights: To enforce our Terms of Use and protect the rights, privacy, safety, or property of our users and the public.

3.4 Facial Recognition

  • Facial Recognition: To match detected activity to individual family members based on uploaded training data.

3.5 Extension Data

  • Extension Data: To supplement screenshots with website and text context for more accurate detection and notifications.

4. Processing and Sharing of Screenshots

4.1 Screenshot Capture and Analysis

  • Local Processing: Screenshots are captured and processed locally on the user's device. Text is redacted, and a blurring filter is applied to preserve privacy.

  • Content Detection: Our AI analyzes the processed screenshots for inappropriate content (e.g., pornography, sexy, hentai, etc).

4.2 Upload and Transmission

  • Secure Upload: Blurred screenshots and associated extension data (such as website URLs, page titles, text, or images) are uploaded to our secure servers at vigilantproject.com.

  • Email Reports: Processed screenshots and relevant extension data may be included in reports sent to your accountability partners via email.

  • Website Access: Accountability partners can view user activity, reports, and related extension data by logging into their account on our website.

4.3 Data Security

  • Encryption: Data transmitted between your device, our servers, and your accountability partners is encrypted using industry-standard protocols.

  • Access Control: Only authorized personnel and your designated accountability partners have access to the processed images, extension data, and reports.

  • Retention: Blurred screenshots and associated extension data are retained in our secure database for 30 days and are automatically deleted thereafter.

4.4 Browser Extension Data

  • Extension Capture: When you install and use our browser extensions, the extension may capture limited activity data such as website URLs, page titles, visible text, and images for the purpose of detecting explicit or inappropriate content.

  • Integration with Screenshots: This data is transmitted securely to the App and may be combined with screenshot analysis to improve detection accuracy.

  • Sharing: Relevant extension data may be included in reports and alerts sent to your designated accountability partners, in the same manner as screenshots.

  • Combined Analysis: Screenshots, extension activity data, and facial recognition results may be combined to improve detection accuracy and reporting.

4.5 Facial Recognition Data

  • Training Images: If you choose to enable facial recognition, you may upload facial images of account users to train the system. These training images are stored securely using encryption and are accessible only to the account holder.

  • Identification: During content detection events, our AI may analyze screenshots or extension data to determine which enrolled family member was active on the device. Identification results may be included in notifications and reports shared with your designated accountability partners.

  • Consent: By uploading images, you confirm you have appropriate consent for each individual, including parental or guardian consent for minors.

  • Retention: Facial recognition training images are retained until deleted by the account holder or until the account is terminated. Identification results may be included in alerts and reports, but training images themselves are never shared with accountability partners.

5. Children's Privacy

5.1 Compliance with COPPA

We are committed to protecting the privacy of children under the age of 13 and complying with the Children's Online Privacy Protection Act (COPPA).

5.2 Parental Consent

  • Parental Involvement Required: Our Services may be used by children under 13 only with the involvement and consent of a parent or legal guardian.

  • Consent Mechanism: By signing up and installing the App on your child's device, you (the parent or guardian) consent to the collection and processing of your child's information as described in this policy.

  • Account holders are responsible for obtaining appropriate permissions before monitoring devices or sharing screenshots with accountability partners.

  • Facial Recognition Consent: If you choose to enable facial recognition on a child’s device, you (the parent or guardian) must upload the training images yourself and provide explicit consent for the processing of your child’s likeness. We do not permit children to upload their own images directly.

5.3 Information Collected from Children

  • User's Name: We collect the child's name to personalize the reports and notifications sent to accountability partners.

  • Screenshots: The App captures screenshots from the child's device to detect inappropriate content.

5.4 How We Use Children's Information

  • Content Monitoring: To analyze screenshots for inappropriate content using our AI algorithms.

  • Notifications to Accountability Partners: To send reports and alerts to the designated accountability partners.

  • Service Provision: To provide and improve our Services as described in this policy.

5.5 Parental Rights

  • Access and Control: Parents have the right to review, request deletion, or refuse further collection of their child's personal information.

  • How to Exercise Rights: To exercise these rights, please contact us at support@vigilantproject.com.

  • Data Retention: We retain personal information for as long as necessary to fulfill the purposes outlined in this policy unless a longer retention period is required or permitted by law.

5.6 No Direct Collection from Children

We do not collect personal information directly from children under 13. All personal information is provided by the parent or guardian during the account setup and installation process.

6. Disclosure of Your Information

We may share your information under the following circumstances:

6.1 With Accountability Partners

  • Reports and Alerts: We share relevant data with the individuals you designate as your accountability partners. This may include processed screenshots, browser extension activity data (such as URLs, titles, text, and images), and, if enabled, facial recognition results identifying which user was active on the device.

6.2 Service Providers

  • Third-Party Vendors: We use trusted third-party services (e.g., payment processors, email and SMS providers, hosting services like Wix) to perform tasks on our behalf.

  • Data Protection: These providers are contractually obligated to protect your information and use it only for the purposes we specify.

  • Notwithstanding the foregoing paragraphs in Section 6, text messaging originator opt-in data and consent will not be shared, sold, or rented to any third parties for their own marketing purposes. Such data will only be shared with third-party service providers essential for facilitating the SMS communications described herein (such as messaging platform providers and mobile carriers).

6.3 Legal Requirements

  • Compliance with Laws: We may disclose your information to comply with legal obligations or respond to lawful requests from public authorities.

  • Protection of Rights: To protect our rights, privacy, safety, property, or those of other persons.

6.4 Business Transfers

  • Transaction Events: In the event of a merger, acquisition, or sale of assets, your information may be transferred to the successor entity.

7.1 Access and Control Over Your Information

  • Data Deletion: You may request the deletion of your personal data or stored screenshots by contacting us at support@vigilantproject.com.

7.2 Communications Preferences

  • Opt-Out: You may opt-out of receiving promotional communications by following the unsubscribe instructions in those emails or by contacting us.

  • Mandatory Communications: Please note that you cannot opt-out of transactional messages necessary for service-related announcements.

8. Data Security

We take reasonable measures to protect your information:

  • Technical Safeguards: Encryption, firewalls, and secure socket layer technology (SSL).

  • Organizational Measures: Restricted access to personal information, staff training on data protection.

  • Facial Recognition Storage: Facial recognition training images and related identification models are stored securely using AWS Key Management Service (SSE-KMS) encryption. These images are retained until deleted by the account holder or until the account is terminated, and are never shared directly with accountability partners except for identification results included in alerts.

  • Extension Data Protection: Browser extension activity data (URLs, titles, and text snippets) is transmitted securely, stored only as long as necessary to generate reports and notifications, and then deleted within 30 days.

9. International Data Transfers

Your information may be processed and stored in countries other than your own. We ensure that such transfers comply with applicable data protection laws and that your information remains protected.

10. Changes to This Privacy Policy

We may update this Privacy Policy periodically. Changes will be effective upon posting the updated policy on our website with a new "Effective Date." We encourage you to review this Privacy Policy regularly.
